Sale contracts, closing statements, and transfer records if investment capital derives from real estate sales.

Notarized gift deed with donor source of funds documentation if any portion of the investment is a gift.

Current passport with at least 6 months validity for the principal investor and all derivative beneficiaries.

Civil birth certificates for the investor, spouse, and all unmarried children under 21.

Civil marriage certificate if including a spouse as a derivative beneficiary.

USCIS specification passport photos: 2x2 inches, white background, taken within 30 days.

Medical exam by USCIS designated civil surgeon (for AOS) or panel physician (for consular processing).

Signed subscription agreement with the regional center project or NCE, documenting the investment terms.

Securities offering document describing the project, business plan, risk factors, and investment structure.

Organizational documents for the New Commercial Enterprise showing investor membership and rights.

Comprehensive business plan demonstrating the job creation methodology (Matter of Ho compliant for direct investment).

Documentation establishing that the project location qualifies as a Targeted Employment Area (Rural, HUA, or Infrastructure).

Economic analysis (typically using RIMS II or IMPLAN methodology) demonstrating that the project will create at least 10 full time jobs per investor.

USCIS project pre-approval for the regional center project. Expedites I-526E adjudication when available.

Identify potential Request for Evidence topics (source of funds is most common) and prepare documentation in advance.

Mark the I-829 filing window: 90 days before the second anniversary of conditional residence. Begin gathering job creation evidence early.
