The November 2025 Court Ruling That Changed Everything On November 14, 2025, a federal court set aside the April 2024 USCIS Final Rule that had dramatically raised filing fees across the immigration system. For EB-5 investors specifically, the ruling reverted all petition and application fees to their pre April 2024 levels, cutting the combined USCIS filing cost by more than $11,000 per application. That is not a rounding error. It is a meaningful reduction in non recoverable costs for every investor who files after the ruling date.
