6 Months to File: The EB-5 Grandfathering Countdown Has Begun

The clock is running. Here is exactly what you need to do before September 30, 2026. On March 15, 2022, the EB-5 Reform and Integrity Act (RIA) restructured the immigrant investor program from the ground up: new investment minimums, new integrity requirements, new set aside categories, and a new filing form. But Congress included a safety net for investors already in the pipeline. Section 102(b) of the RIA established grandfathering provisions allowing pre RIA investors to complete their cases under the prior rules.
