Terms of Use

Agreement governing your use of EB5 Status

Version 2.0, Effective March 11, 2026. These terms were updated to reflect account-based services, free-tier usage limits, prohibited uses, and dispute resolution procedures.

Acceptance of Terms

By accessing and using EB5 Status (the “Site”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Site. EB5 Status reserves the right to change these terms at any time. Your continued use of the Site following publication of changes constitutes your acceptance of the revised terms.

These Terms of Use, along with our Privacy Policy, comprise the entire agreement between you and EB5 Status regarding your use of the Site.

Account Terms

Free Accounts

Free accounts provide access to features beyond the public site, including:

  • Historical data depth of up to 4 quarters, rendered client-side
  • Personalized dashboard based on your country and visa category
  • Basic alert notifications for visa bulletin and processing time changes
  • Watchlist for tracking countries and categories

Free Tier Limits

Free accounts are subject to the following usage limits:

  • API access: Free accounts do not include API access. Programmatic data retrieval requires a Pro or Enterprise subscription.
  • Rate limits: Free account page requests are limited to 100 authenticated requests per day. Requests exceeding this limit may be throttled or temporarily blocked.
  • Data exports: Free accounts may not export, download, or programmatically extract data. All data is rendered client-side for on-screen viewing only.
  • One account per person: Free accounts are limited to one account per individual. Creating multiple accounts to circumvent usage limits is prohibited.

EB5 Status reserves the right to adjust free tier limits at any time. Material changes will be communicated to account holders.

Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must not share your login credentials with others or allow others to access your account. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately.

Paid Subscriptions

Paid plan terms (Pro and Enterprise) will be published when Pro subscriptions launch. Free accounts are governed by the terms above. Pricing, billing, cancellation, and refund terms will be published here at least 30 days before paid subscriptions become available.

Until paid plans launch, all registered users are on the free tier and subject to the free tier limits described above. No payment information is collected or required to use EB5 Status at this time.

Data Licensing and Exports

Data accessed through EB5 Status, whether viewed on the Site or exported via download or API, is licensed for your personal or internal business use only. You may not:

  • Redistribute, resell, or sublicense EB5 Status data to third parties
  • Publish EB5 Status data in competing products or services
  • Remove, alter, or obscure watermarks embedded in exported files
  • Use automated tools to systematically download or extract data beyond your plan's API allocation
  • Share your API credentials or exported data files with unauthorized users

All data exports are watermarked with a timestamp, a hash of your account identifier, and a unique export ID. This watermarking enables us to trace the origin of redistributed data and enforce these licensing terms.

Enterprise subscribers with white-label data licensing rights may redistribute data under the terms of their Enterprise agreement. Contact us for details.

API Usage Terms

API access is available to Pro and Enterprise subscribers. By using the EB5 Status API, you agree to the following terms:

  • Rate Limits: Pro accounts are limited to 1,000 API calls per calendar month. Enterprise accounts are limited to 10,000 API calls per calendar month. Requests exceeding your limit will receive a 429 (Too Many Requests) response.
  • Authentication: All API requests must include a valid API key. API keys are tied to your account and must not be shared or embedded in client-side code.
  • Fair Use: API access is intended for programmatic data retrieval, not for scraping or mirroring the Site. Requests must include appropriate caching and should not exceed 10 requests per second.
  • Availability: We target 99.5% API uptime but do not guarantee availability. Scheduled maintenance windows will be communicated in advance when possible.
  • Versioning: We may update the API with new versions. Deprecated versions will remain available for at least 90 days after a deprecation notice.

Abuse of the API, including exceeding rate limits persistently, attempting to circumvent authentication, or using the API to build a competing product, may result in suspension of your API access or termination of your account.

Prohibited Uses

You may not use EB5 Status or any data obtained through the Site for any of the following purposes. Violation of these prohibitions may result in immediate account suspension or termination.

Resale and Redistribution

  • Reselling, sublicensing, or commercially redistributing EB5 Status data, analysis, or exports to third parties
  • Publishing EB5 Status data or derived content in competing products, databases, or services
  • Sharing account credentials, API keys, or exported data files with unauthorized users
  • Removing, altering, or obscuring watermarks, attribution, or copyright notices

Automated Scraping and Extraction

  • Using bots, scrapers, crawlers, spiders, or other automated tools to extract data from the Site
  • Programmatically accessing the Site outside of the authorized API (when available)
  • Mirroring, caching, or systematically downloading Site content for offline reproduction
  • Circumventing rate limits, authentication, or access controls

Other Prohibited Conduct

  • Attempting to access, hack, probe, or interfere with Site security or infrastructure
  • Transmitting harmful code, malware, or malicious content
  • Creating multiple accounts to circumvent usage limits or a prior suspension
  • Using the Site in violation of any applicable law or regulation
  • Impersonating another person or misrepresenting your affiliation

Permitted personal use: You may view, print, and save individual pages from EB5 Status for personal, non-commercial, informational use only, provided you retain all copyright and proprietary notices. Citation of EB5 Status analysis with appropriate attribution is permitted for non-commercial, editorial, or academic purposes.

Intellectual Property and License to View

Ownership

EB5 Status retains all rights, title, and interest in the Site, its content, data compilations, derived metrics, analysis, software, and design. Nothing in these terms transfers any intellectual property rights to you. Your account grants you a license to access and view data, not to own, redistribute, or derive competing products from it.

Your License

Subject to your compliance with these terms, EB5 Status grants you a limited, non-exclusive, non-transferable, revocable license to access and view data and content on the Site for your personal or internal business use. This license does not include the right to download, export, copy, reproduce, or redistribute data except as expressly permitted by your subscription tier.

Government-Sourced Data

Data published by the U.S. government (e.g., Department of State Visa Bulletins, USCIS statistics, Federal Register notices) is in the public domain and is not subject to copyright. You may use the underlying government data freely, subject to the terms of the original source. However, EB5 Status's specific compilation, organization, presentation, and analysis of government data is our proprietary work.

EB5 Status Proprietary Content

The following are our intellectual property and are protected by copyright:

  • Derived metrics and calculated fields (e.g., approval rates, trend analysis, movement projections)
  • Chart designs, data visualizations, and interactive tools
  • Editorial analysis, articles, and commentary
  • Database structure, taxonomy, and data organization
  • Brand identity, logos, and design elements
  • Software code, user interface, and application logic

Data Accuracy and Disclaimer of Advice

EB5 Status is not a law firm, regional center, investment adviser, broker-dealer, or immigration consultancy. Nothing on this Site constitutes legal advice, immigration advice, investment advice, or financial advice. No attorney-client, fiduciary, or advisory relationship is created by your use of this Site.

Data presented on EB5 Status is sourced from U.S. government publications, FOIA disclosures, and our own derived analysis. While we strive for accuracy:

  • Government source data may contain errors, be revised after publication, or be incomplete
  • Derived metrics and calculations reflect our methodology, which is documented but may contain errors
  • Processing time estimates and forward projections are statistical estimates, not guarantees
  • Data may not reflect the most recent updates if source publications are delayed

You should not make immigration, investment, or legal decisions based solely on information from this Site. Always consult a qualified immigration attorney or licensed professional before making decisions about your EB-5 case or investment.

Disclaimer of Warranties

EB5 Status provides the Site “as-is” and “as-available” without any warranties, express or implied. To the fullest extent permitted by law, we disclaim all warranties including:

  • Warranty of merchantability or fitness for a particular purpose
  • Warranty of title or non-infringement of third-party rights
  • Warranty of accuracy, completeness, or timeliness of content
  • Warranty that the Site or API will be uninterrupted, error-free, or secure
  • Warranty regarding the quality or reliability of any services

EB5 Status makes no warranty that the Site will meet your requirements or expectations. Any reliance on Site content is at your sole risk. Data presented on the Site may contain errors or be out of date. EB5 Status is not a law firm, regional center, or investment adviser, and nothing on the Site constitutes legal, immigration, or investment advice.

Limitation of Liability

To the fullest extent permitted by law, in no event shall EB5 Status, its operators, employees, or agents be liable for any damages arising from your use of the Site, your reliance on its content, or your subscription, including:

  • Direct, indirect, incidental, or consequential damages
  • Loss of profits, revenue, data, or business opportunity
  • Business interruption or lost productivity
  • Decisions made based on data or analysis presented on the Site
  • Cost of substitute goods or services

In any case, EB5 Status's total liability to you for all claims arising from your use of the Site or subscription shall not exceed the total amount you paid to EB5 Status in the 12 months preceding the claim. This limitation applies even if EB5 Status has been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability, so this limitation may not fully apply to you.

User Content

If you submit comments, feedback, or other content to EB5 Status, you grant us a non-exclusive, royalty-free license to use, modify, and distribute that content. You represent that you own or have the right to submit such content and that it does not infringe third-party rights.

EB5 Status is not responsible for user-submitted content and may remove or modify content at its discretion. We do not endorse user content and are not liable for its accuracy or legality.

Account Suspension and Termination

EB5 Status may suspend or terminate your account, without prior notice, if we determine in our sole discretion that you have violated these Terms of Use. Grounds for suspension or termination include but are not limited to:

  • Automated scraping or data extraction: using bots, scrapers, or automated tools to access the Site outside authorized channels
  • Redistribution or resale: sharing, reselling, or commercially redistributing EB5 Status data or exports
  • Rate limit abuse: persistently exceeding usage limits or circumventing rate controls
  • Credential sharing: sharing login credentials or API keys with unauthorized users
  • Multiple accounts: creating duplicate accounts to circumvent limits or a prior suspension
  • Competitive use: using Site data or structure to build a competing product or service
  • Security interference: attempting to hack, probe, or interfere with Site security or infrastructure
  • Abusive conduct: harassment, threats, defamation, or any unlawful behavior on the Site

Suspension Process

For non-urgent violations, we will attempt to notify you by email before or at the time of suspension. For urgent violations (e.g., active scraping, security attacks), we may suspend access immediately without prior notice. Suspended accounts may be reinstated at our discretion after the violation is resolved.

Effect of Termination

Upon termination for cause, your access ceases immediately and no refund is issued for any remaining billing period. Sections of these terms that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Dispute Resolution) will survive. You may request deletion of your account data per our Privacy Policy.

Dispute Resolution

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles.

Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact EB5 Status and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly and to your satisfaction through direct communication.

Binding Arbitration

If we cannot resolve a dispute informally, you and EB5 Status agree to resolve any claims relating to these Terms of Use or your use of the Site through final and binding arbitration, rather than in court, except that either party may bring claims in small claims court if they qualify. Arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, or by another mutually agreed arbitration provider.

Arbitration shall take place in New York, New York, or at another mutually agreed location, and may be conducted by phone, video conference, or based on written submissions if both parties agree. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. If this class action waiver is found to be unenforceable for a particular claim, then the entirety of this arbitration provision shall be deemed void for that claim only.

Exceptions

Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, data licensing terms, or confidentiality obligations.

Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Changes to Terms

EB5 Status reserves the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to the Site. If we make material changes that affect paid subscribers, we will notify account holders by email at least 30 days before the changes take effect. Your continued use of the Site following publication of changes constitutes your acceptance of the revised terms.
