Capital transfer from the UK to the United States is generally straightforward. The Bank of England does not impose individual outbound remittance restrictions, and the UK's robust financial system facilitates large international transfers. Source of funds documentation must demonstrate the lawful origin of investment capital through employment records, business ownership documentation, inheritance records, property sales, or other verifiable sources. UK based investors should coordinate with tax advisors regarding potential UK Capital Gains Tax implications and U.S. tax obligations that arise upon becoming a U.S. permanent resident.
UK nationals benefit from a well established consular processing infrastructure at the U.S. Embassy in London. The embassy handles a high volume of immigrant visa cases, and scheduling for EB-5 immigrant visa interviews is generally efficient compared to some other jurisdictions.
The reserved visa categories under the 2022 Reform and Integrity Act provide additional options. Rural TEA projects offer a 20% visa set aside with priority processing, while HUA projects receive a 10% allocation. Both remain Current for UK nationals.
Processing timelines for UK investors follow general USCIS patterns: approximately 18 to 28 months for I-526E adjudication, with potential priority processing for rural TEA projects.
The September 30, 2026 grandfathering deadline is a critical consideration. Filing before this date preserves current investment minimums ($800,000 TEA / $1,050,000 non TEA), while post deadline filings will be subject to CPI-U adjusted amounts beginning January 2027.
