American Immigration Lawyers Association Publishes Comprehensive EB-5 Practitioner Guide, 2025 Edition

The American Immigration Lawyers Association published the 2025 edition of its comprehensive EB-5 Practitioner Guide on October 30, 2025. The updated 88-page resource, developed by a committee of leading EB-5 specialists, addresses the current regulatory landscape and provides practical guidance on critical practice areas including RIA compliance verification, source of funds documentation strategies, regional center financial evaluation, and project due diligence protocols.

The guide reflects changes in law and practice implemented since the 2022 regulatory reforms and addresses emerging practice issues including cryptocurrency asset liquidation documentation, digital payment verification, and contemporary compliance framework implementation. The document includes detailed checklists, sample documentation templates, and analysis of recent administrative appeals and litigation addressing key EB-5 legal issues.

AILA indicated that the updated guide will be continuously revised as additional regulatory guidance and case law develop. The guide is available for free download from the AILA website and has been distributed to all AILA member organizations. Early feedback from immigration attorneys indicates that the updated guidance has been extremely helpful in case preparation and client counseling regarding EB-5 program participation.
